(2) LAND USE

"All of the lands covered by these restrictions shall be known and used for residential purposes. No structure shall be erected, altered, placed, or permitted to remain on each lot or homesite other than one single-family dwelling, a private garage, servants quarters, barn, and outbuildings used in connection with such dwelling. This provision shall exclude hospitals, duplex houses, apartment houses, multiple family houses, places of worship, and all structures of whatever kind or character designed or used for commercial or industrial purposes"

Residential Use Only: The lands are strictly for residential purposes, emphasizing the exclusivity to living spaces rather than commercial or industrial use.

Permitted Structures: Only specific structures are allowed:

  • Single-family dwelling: A residential house designed for one family only.

  • Private garage: A garage for private use, not for commercial or public use.

  • Servants' quarters: Living quarters for domestic help.

  • Barn: Typically used for storing farm equipment or housing livestock, but in this context, likely for personal use related to the residence.

  • Outbuildings: Other minor structures like sheds or workshops as long as they are used in connection with the main dwelling.

 

Excluded Structures: The covenant explicitly prohibits certain types of buildings, which include:

  • Hospitals

  • Duplex houses: Buildings divided into two separate residences.

  • Apartment houses: Larger buildings divided into multiple residential units.

  • Multiple family houses: Any dwelling designed to house more than one family.

  • Places of worship

  • Commercial or industrial structures: Any buildings used for commercial (shops, offices, etc.) or industrial (factories, warehouses, etc.) purposes.

1. SUBDIVISION AND HOMESITES

I.(A). The property has been subdivided into homesites or lots. No residence shall ever be constructed on a homesite or lot containing less than two acres of land, any existing lot on which a residence may be constructed under paragraph I of the original RESTRICTIVE COVENANTS filed on January 25, 1993 under Fort Bend County property records filing number 9303973 will remain qualified as a "homesite" on which a residence may be constructed under the AMENDED AND RESTATED RESTRICTIVE COVENANTS.
